Terms and Conditions

Under these terms and conditions, The Contractor (we/our) agrees to supply to the Client (you/your) the Goods and Services set out in the Quotation within this Agreement. These terms set out all the terms of the Contract between the Contractor and the Client.

1. Acceptance of the Contractor’s Quotation by the Client constitutes a Contract for the Contractor to carry out the Works in accordance with these Conditions.

2. Our designs and products are bespoke, which means that they are handmade to your specific project. Before placing your order please ensure that all details are correct and that you are happy with the design, materials and finish / colour decisions.

3. Between placing your order and the commencement of the manufacturing process we allow a cooling off period of 24 hours during which time you may still cancel your order and a full refund will be made. After that time our bespoke manufacturing process and ordering of white goods begins. We regret that we are not able to offer any refund once this process has commenced.

4. The Contractor will exercise skill and care in the performance of the Works.

5. The Contractor will not be liable for any loss or consequential liability, or damage sustained by the Client due to circumstances beyond the Contractor’s control.

6. The price we will charge you for the goods and services will be as stated in the quotation. In certain circumstances where unforeseen work is required we may need to adjust the price quoted. In these circumstances we will tell you what the cost of the extra work will be, and you can then choose to continue with the Contract or cancel it by agreement together with settlement of any outstanding amounts already incurred.

7. We will to the best of our ability install the project as specified and quoted. However, should anything outside of our control affect our ability to manufacture, deliver or install (such as building works etc.) we reserve the right to return furniture to the workshop to make necessary adjustments, however this will incur additional time and potential cost.

8. Because our furniture is bespoke (made by hand) it is not always possible to anticipate every variation that may occur during the installation process. As a consequence, the fit may require additional time to install to our satisfaction.

9. Occasionally delays occur in the sourcing and supply of materials. Should this occur, we will suggest the best approach which may include modifying the design subject to agreement.

10. It is a condition of this contract that the working environment is safe and one where we and subcontractors may work in a mutually respected & constructive way.

11. It is a condition of this contract that there is safe, clear, and unobstructed access into the site when delivering. Obstruction or unsafe environments will prevent delivery and will incur delay and additional cost.

12. For contracts above £1,000 a deposit of 50% of the total is required on confirmation of the works. Upon payment of the 50% deposit the Client agrees to the Terms & Conditions set out in this contract and manufacturing can begin. On completion of manufacturing, but prior to delivery, a pre-delivery payment of 45% is due and payable. Upon receipt of this second payment delivery of the goods will take place and installation will commence. A final payment of 5% of the contract value is due to the contractor on completion of the contract.

13. For contracts up to £1,000 a payment of 100% of the total is required immediately for confirmation of the works. Only when the required payment is made will works commence.

14. We only accept payments by BACS. Payment is due within 7 days upon receipt of invoice.

15. In the event of the Client failing to make any payment due under the terms of this agreement or otherwise defaulting on any of the Client’s obligations hereunder the Contractor may suspend or terminate this agreement and recover any reasonable costs from the Client.

16. Outstanding payments will incur interest at a rate of 8% plus the current base rate and will be charged daily until payment is made in full. Materials supplied by the Contractor remain the property of the Contractor until the final payment has been made and a chargeable rate for their use will be 10% of their value per day. If work is delayed or interrupted due to the fault of the Client then the Contractor will be entitled to be paid for any losses or additional costs arising.

17. The Contractor is responsible for the Health & Safety of the Contractor’s employees and subcontractors only. Under no circumstance should persons other than those employed by or contracted to the Contractor be in the work area whist work is being undertaken.

18. The Contractor will not be responsible for pets in the Client’s property. Please ensure all animals are contained.

19. If the Client wishes to vary any of the Works in progress, the Contractor must be informed in good time and in writing and subject to the Contractor’s agreement. The Contractor will advise of any additional costs and time delays that such variation will incur.

20. Whilst we take great care to avoid damage to your home, it is possible that during certain installations, there may be localised damage to the fabric of your property. Under these circumstances we cannot be held liable for such damage so far as is reasonable.

21. The Client is responsible for obtaining all Planning Consents and complying with Building Regulations.

22. Should delivery of the contract become frustrated due to a breakdown in the relationship between the Contractor and Client, any refunds will only be considered based on the received funds to date.

23. We will use our best endeavours to install the goods on or as close to the completion date of this Agreement or as otherwise agreed with you, but cannot be responsible if there is a delay due to matters beyond our reasonable control such as adverse weather.
